Successful application by the Attorney-General for leave to intervene in an application by D for leave to appeal in relation to orders that restricted her from commencing or continuing civil proceedings. Unsuccessful application by D for various orders (a) to add parties, (b) to appoint an intervener and an amicus curiae and (c) for recusal of three Supreme Court Judges.

Unsuccessful application by E for the appointment of a named person as amicus curiae for his application for leave to appeal.

 

Tsao v Chen  [2025] NZSC 20

27 March 2025

Unsuccessful application by T for leave to appeal against the refusal by the Court of Appeal to grant an extension of time to appeal.

 

Rafiq v Auckland Transport  [2025] NZSC 19

26 March 2025

Unsuccessful application by R for leave to appeal against a refusal to review a decision not to waive a filing fee for his appeal. R had sought to file an appeal in relation to infringement notices issued by Auckland Transport.

 

Burden v ESR Group (NZ) Ltd  [2025] NZSC 18

25 March 2025

Successful appeal by B and others against a Court of Appeal decision that had disallowed a damages award against EGL in relation to infringement of copyright. Issues addressed were (a) whether a copyright owner’s consent was necessary for a work to be ”in circulation” and (b) whether circulation outside NZ was “circulation”.

 

Slavich v Wellington District Court  [2025] NZSC 17

24 March 2025

Unsuccessful application by S for (a) leave to appeal against the striking out of his appeal to the Court of Appeal on the grounds that he had not paid the filing fee and (b) recusal of counsel for the Attorney-General.

 

Siemer v Attorney General  [2025] NZSC 16

20 March 2025

Unsuccessful application by S for review of the Deputy Registrar's refusal to waive the filing fee for his appeal.

 

Parker v R  [2025] NZSC 15

20 March 2025

Unsuccessful application by P for review of the Registrar's refusal to accept his application for leave to appeal for filing. P had sought to appeal against the Court of Appeal's refusal to review a decision not to accept his appeal for filing on the grounds that an extension of time to appeal had been declined by the High Court.

 

Jury v R  [2025] NZSC 14

17 March 2025

Partially successful application, out of time, by J for leave to appeal against conviction for murder.

The approved questions were (a) whether the trial court erred by admitting hearsay statements in evidence and (b) whether the trial court erred by failing to give a reliability direction about those statements.

 

M v R  [2025] NZSC 13

Unsuccessful application by M for leave to appeal against conviction for historic sexual offending against a child.

Unsuccessful application by M for an extension of time to file his application for leave to appeal against conviction and sentence for burglary.

 

Alalääkkölä v Palmer  [2025] NZSC 9

06 March 2025

Unsuccessful appeal by A against a finding by the Court of Appeal that copyright in artworks created by A during A and P’s marriage was property for the purposes of the Property (Relationships) Act 1976.

Successful application by E for review of the Registrar's refusal to accept his application for leave to appeal.

04 March 2025

Unsuccessful application by T for leave to appeal against her conviction and sentence for breaching an order that had disqualified her from being in charge of animals for five years.
