Unsuccessful application by B-N for leave to appeal against a refusal to award him indemnity costs in relation to his judicial review of AUPIHP’s decision-making process.

 

Ropitini v R  [2025] NZSC 60

27 May 2025

Unsuccessful application by R for leave to appeal against conviction for doing indecent acts on a young person. R argued that propensity evidence should not have been admitted at his trial.

 

Repia v R  [2025] NZSC 59

27 May 2025

Successful application by R for leave to appeal in relation to a finding that he had sexually violated a complainant. R had been found unfit to stand trial.

The approved question was whether the Court of Appeal had been correct to dismiss R's appeal on the basis that his reasonable belief in consent was excluded from inquiry in an involvement hearing under s 10 Criminal Procedure (Mentally Impaired Persons) Act 2003.

Unsuccessful application by VICL and another for leave to appeal against determinations that (a) they owed MGL and another a duty of confidence and (b) an account of profits was an appropriate remedy.

 

J v R  [2025] NZSC 56

21 May 2025

Unsuccessful application by J for leave to appeal against conviction and sentence for the rape of his 14 year old daughter.

 

J v R  [2025] NZSC 55

20 May 2025

Unsuccessful application by J for leave to appeal against conviction for money laundering. Issue at trial was whether J was the driver of a car that was videoed arriving and departing from a site where $500,000 cash had been picked up.

 

Pascoe v Minister for Land Information  [2025] NZSC 54

19 May 2025

Successful application by the Ps for leave to appeal in relation to compulsory acquisition of land under s 18 Public Works Act 1981.

The approved question was whether the Court of Appeal correctly found that negotiations prior to the compulsory acquisition could be undertaken by an accredited contractor rather than the Minister or Land Information NZ.

Unsuccessful application by G for leave to appeal against a finding that he had not been denied minimum entitlements to exercise while on segregation in prison.

 

AB v R  [2025] NZSC 49

Unsuccessful application by AB for leave to appeal certain convictions on the ground that his removal from Australia and return to New Zealand had amounted to a disguised extradition.
