New chapter in Adams on Criminal Law (new Westlaw New Zealand)

Adams on Criminal Law — Procedure author Jeremy Finn has written a new discursive chapter titled Extra-judicial Challenges to Conviction or Sentence [EJC], following the commencement of the Criminal Cases Review Commission Act 2019 in July 2020.

This new chapter includes commentary on the background, functions and processes of the Criminal Cases Review Commission (CCRC). It provides practical guidance on applications to the CCRC to have a conviction or sentence referred to the courts as, essentially, a fresh appeal. Two other means of challenging a conviction or sentence are also discussed: seeking to have the Crown exercise its prerogative power of mercy by granting a pardon or by respiting or remitting some or all of the sentence imposed on a defendant.

Commentary on this interesting area of criminal law will be regularly updated in line with case law and legislative developments.
