Commentary on the Search and Surveillance Act 2012 has been updated in Adams on Criminal Law in response to amendments by the Criminal Activity Intervention Legislation Act 2023.

Criminal Activity Intervention Legislation Act 2023

This Act came into force on 5 April 2023. The legislation creates new powers and offences to assist police to prevent and respond to harm caused by criminal offending. It includes search powers for weapons when gang conflicts are occurring and tools to disrupt potential money-laundering activities. Commentary across various chapters in Adams on Criminal Law is currently being updated to reflect changes by the Act.

Search and Surveillance Act 2012 commentary updating

New commentary under the 2012 Act has been added to Adams on Criminal Law — Rights and Powers in the following locations:

  • Sections 18A–18G (Warrants to search and seize weapons when there is gang conflict): see [SS18A.01]–[SS18A.03], [SS18B.01], [SS18C.01], [SS18D.01], [SS18D.02], [SS18E.01], [SS18F.01] and [SS18G.01].
  • Sections 123A–123E (Seizure of cash found in suspicious circumstances): see [SS123A.01], [SS123B.01], [SS123B.02], [SS123C.01], [SS123D.01], [SS123E.01] and [SS123E.02].
  • Section 160A (Disposal of weapons): see [SS160A.01].
  • Section 171A (Information to be included in report on warrants under subpart 6A of Part 2): see [SS171A.01].

Existing commentary under the 2012 Act has been updated in the following locations:

  • Section 6 (Issuing officer may issue search warrant): see [SS6.02].
  • Section 45 (Restrictions on some trespass surveillance and use of interception device): see [SS45.01].
  • Section 104 (Issuing officer may require search warrant report): see [SS104.03].
  • Section 131 (Identification and notice requirements for person exercising search power (other than remote access search)): see [SS131.02] and [SS131.06].
  • Section 149 (Disposal of things seized or produced): see [SS149.01].
  • Section 170 (Annual reporting of search and surveillance powers by Commissioner): see [SS170.01].
