Corporate Insolvency – revised commentary

Corporate Insolvency author Stephen Revill has been revising commentary under pts 15A and 16 of the Companies Act 1993, to reflect changes by important cases and to improve readability.

The following provisions of the Act have been revised:

  • Removal of administrator, [CA239R.01];
  • Conduct of creditors' meetings, [CA239AK.01];
  • Related creditor’s vote disregarded unless court orders otherwise, [CA239AM.01];
  • Enforcement of security interest over collateral for qualifying derivative, [CA239ABMA.01];
  • Court may set aside statutory demand, [CA290.01];
  • Power of Court to require persons to repay money or return property, [CA301.01].
