Criminal Precedents — new and amended forms

The Criminal Proceeds (Recovery) Amendment Regulations 2023 came into force on 27 July 2023. As well as amending regs 4–7 of the Criminal Proceeds (Recovery) Regulations 2009, various forms in the Schedule of the 2009 Regulations were amended and some new forms were created. The corresponding Drafting Aide versions of these forms have been updated/inserted in Criminal Precedents on Westlaw New Zealand.

The relevant Drafting Aide forms are:

  • CPR01A — On-notice application for restraining order (before type 2 assets forfeiture order) — Form 1A [NEW]
  • CPR02A — Without-notice application for restraining order (before type 2 assets forfeiture order) — Form 2A [NEW]
  • CPR06 — Application to have severable interest in restrained property excluded from restraining order — Form 6 [updated]
  • CPR14 — Application for type 1 assets forfeiture order — Form 14 [updated]
  • CPR14A — Application for type 2 assets forfeiture order — Form 14A [NEW]
  • CPR18 — Type 1 assets forfeiture order — Form 18 [updated]
  • CPR18A — Type 2 assets forfeiture order — Form 18A [NEW]
  • CPR27 — Application to have respondent’s effective control over property treated as interest in property — Form 27 [updated]
  • CPR28 — Order that respondent’s effective control over property be treated as interest in property — Form 28 [updated]
  • CPR29 — Application for relief from civil forfeiture order — Form 29 [updated]
  • CPR31 — Application for disclosure of source order — Form 31 [NEW]
  • CPR32 — Disclosure of source order — Form 32 [NEW]
