Duty of receiver selling property under the Receiverships Act – new commentary in Insolvency Law

Receivers have a duty under s 19 of the Receiverships Act 1993 to obtain the “best price reasonably obtainable” when selling a property in receivership.

The plaintiffs were successful in their claim in Reynolds v Finnigan [2023] NZHC 48 that the receivers had sold an early education centre business at an undervalue, causing loss to its shareholders. Click on the link to Insolvency Law for discussion of the Court’s approach: [RA19.01(2)].
