Family Precedents – prescribed forms amended

The Family Court Amendment Rules 2024 came into force on 2 May. As outlined in the explanatory note, they amend the Family Court Rules 2002 (FCRs) to confer on the new Family Court Associates (discussed in another post) functions and powers additional to those set out in the Family Court Act 1980. Included in the amendments are changes to some of the forms prescribed in schedules to the FCRs. Accordingly, the Drafting Aide versions of these forms have been updated in Family Precedents (online ed, Thomson Reuters).

Updated forms for proceedings under the Child Support Act 1991 (FCRs, sch 3):

  • CS25 — Notice of application to respondent
  • CS26 — Notice of application to respondent residing outside New Zealand

Updated forms for proceedings under the Family Violence Act 2018 (FCRs, sch 5):

  • FV02 — Notice to respondent or associated respondent
  • FV03 — Summons to appear as witness (or appear before court)

Updated forms for proceedings under the Family Proceedings Act 1980 and subpart 4 of pt 2 of the Care of Children Act 2004 (FCRs, sch 6):

  • FP16 — Notice to respondent of application under Family Proceedings Act 1980 or subpart 4 of Part 2 of Care of Children Act 2004
  • FP17 — Notice to respondent residing outside New Zealand of application under Family Proceedings Act 1980 or subpart 4 of Part 2 of Care of Children Act 2004
  • FP30 — Bail bond
  • FP31 — Warrant of deliverance on execution of bail bond
  • FP33 — Warrant to take child to prevent removal from New Zealand
  • FP49A — Warrant to prevent concealment of whereabouts of child

Updated forms for proceedings under the Property (Relationships) Act 1976 (FCRs, sch 8):

  • PR02 — Notice to respondent of application
  • PR04 — Warrant to arrest respondent for examination
  • PR05 — Summons to witness to attend examination
  • PR06 — Warrant to arrest witness for attendance at examination

Updated forms for proceedings under the Care of Children Act 2004 (FCRs, sch 10):

  • COC01 — Notice to respondent of application under Care of Children Act 2004
  • COC02 — Notice to respondent residing outside New Zealand of application under Care of Children Act 2004
  • COC04 — Warrant to take child to prevent removal from New Zealand
