This Accident Compensation (Maternal Birth Injury and Other Matters) Amendment Act 2022 (which can be found in the Legislation section of New Westlaw, Practice Area – Personal Injury) expands cover to include specific maternal birth injuries (see new Schedule 3A for the list of birthing injuries covered) as accidents which will mean wāhine/birthing parents will be eligible for support from ACC. Anyone who gives birth and suffers a birthing injury under Schedule 3A will benefit from this Act including women, non-binary, transgender, and other gender-diverse groups. ACC Minister Carmel Sepuloni said the Act will improve the gender balance, fairness, and equity of the ACC scheme.

The Act however is not retrospective so people who have already suffered injuries will not be covered, and it does not cover birthing injuries to babies.
