Terry v NZ Police  [2022] NZSC 137

30 November 2022

Unsuccessful application by T for leave to appeal against (a) conviction for driving while disqualified and wilful damage and (b) a sentence of a $500 fine, six months’ disqualification and reparations.

 

P (SC 91/2022) v High Court at Auckland  [2022] NZSC 136

22 November 2022

Unsuccessful application by P for leave to appeal against a Court of Appeal decision that it did not have jurisdiction to hear an appeal because P would have had to obtain leave to appeal under s 124 Human Rights Act 1993 in relation to her child support claim.

 

Make it 16 Inc v AG   [2022] NZSC 134

21 November 2022

Successful appeal by MI16 against a Court of Appeal decision not to make a declaration due to the political nature of the issue in question. MI16 had applied for a declaration that provisions in the Electoral Act 1993 and Local Electoral Act 2001 were inconsistent with the right to freedom from discrimination on the basis of age, as protected by s 19 New Zealand Bill of Rights Act 1990.

18 November 2022

Unsuccessful application by PH for leave to appeal against a Court of Appeal decision that had struck out her leave to appeal because she had failed to pay security for costs.

 

Cloud Ocean Water Ltd v Aotearoa Water Action Inc   [2022] NZSC 133

17 November 2022

Successful application by COWL for leave to appeal against a Court of Appeal decision to allow an appeal by AWAI against the granting of consents by Canterbury Regional Council to use water for bottling. Had been existing consents in place for taking water for different industrial purposes.

 

Tupa’i v R   [2022] NZSC 132

16 November 2022

Unsuccessful application by T for leave to appeal against conviction for sexual and violent offending against a young family member. One jury member had been discharged after being unable to continue to perform their duties on the second day of deliberations.

 

Memelink v Collins May Law   [2022] NZSC 130 

10 November 2022

Unsuccessful application by M for an extension of time to apply for leave to appeal against being adjudicated bankrupt.

 

Wheeler v R   [2022] NZSC 129 

10 November 2022

Unsuccessful application by W for an extension of time to apply for leave to appeal against a sentence of life imprisonment for murder with a minimum period of imprisonment of 10 years.

 

George v R   [2022] NZSC 128 

7 November 2022

Unsuccessful application by G for leave to appeal against conviction for distributing an objectionable publication.

 

Jiaxin Finance Ltd (in liq) v R   [2022] NZSC 127 

4 November 2022

Unsuccessful application by Qiang Fu (F) and Fuqin Che (C) for leave to appeal against their conviction for offences under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. F and C had been charged as secondary parties to JFL.
