Successful appeal by MoJ against the quashing of MoJ’s decision to surrender K to China to face trial for homicide.

Successful application by S for leave to appeal against a relationship property division.

 

Cowan v Cowan  [2022] NZSC 43

12 April 2022

Unsuccessful appeal by C and TR Cowan (CC) against removal of a caveat over a property owned by their father J Cowan (JC). JC had agreed to sell the family home to a third party. CC’s caveat had been removed because her undertaking as to damages was not of sufficient substance.

Unsuccessful application by C for leave to appeal against imposition of a five year extended supervision order for (a) indecent assault and (b) sexual exploitation of a person with significant impairment.

 

Johnston v Auckland Council  [2022] NZSC 40

06 April 2022

Unsuccessful application by Js for leave to appeal against conviction for being owners of a dog that had attacked a domestic animal. The dog had entered private properties and killed a chicken and a guinea pig.

 

Maid v R  [2022] NZSC 39

04 April 2022

Unsuccessful application by M, out of time, for leave to appeal against conviction for taking an imitation explosive device into the security enhanced area of an airport.

 

Seymour v Police  [2022] NZSC 38

Unsuccessful application by S for leave to appeal against conviction for doing an indecent act on a child. S had taken two photographs of a 10 year old girt while she was asleep in his care.

 

EA v Rennie Cox Lawyers  [2022] NZSC 37

04 April 2022

Unsuccessful application by EA for leave to appeal against reinstatement of timetabling directions in relation to a default judgment obtained by RCL.

 

Biscuit Creek Forest Ltd v Vallance  [2022] NZSC 36

01 April 2022

Unsuccessful application by BCFL for leave to appeal against cancellation of a contract with the Vs for sale of a forestry right. Contract had been entered into under a common mistake and resulted in an unequal exchange of values.
