Unsuccessful application by D for recall of a judgment dismissing her application for leave to appeal from a judgment of the High Court.

15 April 2025

Unsuccessful application by T for leave to appeal against refusal of permanent name suppression. T had been convicted of kidnapping and detained as a special care patient.

Unsuccessful application by S for recall of a judgment declining his application for leave to appeal against a Court of Appeal decision which had refused him an extension of time and struck out his appeal.

 

Brice v R  [2025] NZSC 37

11 April 2025

Unsuccessful application by B for leave to appeal against (a) conviction for indecent assault and (b) sentence of community detention and supervision plus reparation. B's application for discharge without conviction and name suppression had been refused.

 

NZME Publishing Ltd v Tarrant [2025] NZSC 36  [2025] NZSC 36

11 April 2025

Unsuccessful application by NZMEPl for leave to appeal against a Court of Appeal decision which had granted an application by Lawyers A and B for name suppression. Lawyers A and B were counsel for T, who was appealing his convictions.

 

Chief of Defence Force v Four Members of the Armed Forces  [2025] NZSC 34

11 April 2025

Successful appeal by CoDF against a finding by the Court of Appeal that limits on protected rights, imposed by a Temporary Defence Force Order in 2022, had not been shown to be justified. The Order had placed restrictions on members of the Armed Forces who had not been fully vaccinated against COVID-19.

 

Sinclair v R  [2025] NZSC 33

Unsuccessful application by S for leave to appeal against conviction for the murder of his infant. S wished to argue that the Court of Appeal was wrong in its interpretation of s 32 Evidence Act 2006.

Unsuccessful application by KPL for leave to appeal against the rejection of their challenge to an open space covenant granted to QE2NT by a previous owner.

Unsuccessful application by C for review of the Registrar's refusal to accept his application for filing.

Unsuccessful application by S for leave to appeal directly from a High Court decision in relation to the Crown's duty to customary owners to reserve a tenth of land sold for the Nelson settlement.

 

Gallacher v R  [2025] NZSC 30

04 April 2025

Successful application by G for leave to appeal against sentence for sexual offending.

The approved question was whether the Court of Appeal was correct to dismiss G's appeal against sentence.

Unsuccessful application by D for leave to appeal against a High Court decision that had struck out her claims against a Tenancy Adjudicator and a District Court Judge.

Unsuccessful application by C for leave to appeal against a sentence of nine years and six months' imprisonment for importation and supply of Class A drugs.

 

Davis v Robinson  [2025] NZSC 25

Unsuccessful application by D for leave to appeal against a Court of Appeal decision that had upheld a finding that her proceedings were an abuse of process and should be struck out.
