The approved question was whether the Court of Appeal was correct to refuse M continued interim name suppression until final disposition of proceedings.

Unsuccessful application by D for leave to appeal against conviction for rape. D wished to argue that the trial Judge should have given the jury a reliability warning about the complainant's intoxication.

Unsuccessful application by A-R for review of the Registrar’s decision not to accept A-R’s application for leave to appeal in relation to a mortgagee sale.

11 July 2025

Largely successful application by NZME Publishing Ltd for access to submissions filed in G’s appeal.

Unsuccessful application by D for leave to appeal Court of Appeal decision declining to review Registrar's refusal to reduce or dispense with security for costs.

Unsuccessful application by D for leave to appeal against dismissal of his application for judicial review of a refusal to stay proceedings against him. His prosecution for assault with a weapon and attempting to pervert the course of justice had subsequently been stayed.

Unsuccessful application by R for review of the Registrar's refusal to accept R's application for leave to appeal.

Unsuccessful application by W for leave to appeal against findings that he had engaged in fraud and conspiracy in relation to a purported agreement with KIL.

Successful application by KIL for leave to appeal against the discharge of permanent anti-suit and anti-enforcement injunctions awarded to it by the High Court.

The approved question was whether the Court of Appeal had been correct to discharge the injunctions.

 

K v R  [2025] NZSC 74

03 July 2025

Successful application by K for leave to appeal against conviction for sexual offending against a child.

The focus on appeal was to be whether a miscarriage of justice had been caused by the trial Judge's directions in summing up.

 

Iongi v R  [2025] NZSC 73

03 July 2025

Partially successful application by I for leave to appeal against conviction and sentence for manslaughter.

The approved question was whether the Court of Appeal had been correct to dismiss I's appeal against conviction. Leave to appeal against sentence was declined.

 

Tamati v R  [2025] NZSC 70

03 July 2025

Unsuccessful appeal by T against conviction for sexual offending against a young person under 16 and supplying her with Class A drugs. The approved questions on appeal were (a) whether errors by trial counsel had led to a miscarriage of justice and (b) whether a reliability warning should have been given to the jury.

Unsuccessful application by Fuller for leave to appeal against the striking out of his claims in relation to actions taken by Fraser as a District Court Judge.

Unsuccessful application by NZTPPTEU for leave to appeal against a finding that split shifts for bus drivers consisted of multiple work periods within a day.
