The commentary includes a large introduction, which covers the legislative history, the structure of the Act, the key changes and an overview of all the areas not covered by the Trusts Act 2019. We had to break into two volumes for Family Property looseleaf to accommodate it all. We are so very fortunate to have the commitment of Professor Emerita Nicola Peart to this work, someone who was on the Law Commission’s expert panel, who has taken part in conferences on the Act throughout the country and has a great understanding of the Act that Parliament produced and the judgments coming out of the courts on it.

For the most recent update (currently online and in letterboxes), Professor Peart has added new commentary on ss 139 (“Court may order payment of remuneration to trustee”) and 140 (“Court may charge costs on trust property”). These are the last two sections of pt 7 “Court powers and dispute resolution”, before that part starts to consider jurisdiction of the Family Court.

Apart from the comprehensive coverage we now have in the product and the confidence that the reader can have in what is in there, it is also refreshingly clean and clear in style. You will never have to read the same sentence twice.
