Easton v Registrar of the High Court of New Zealand  [2022] NZSC 90

22 July 2022

Unsuccessful application by E for recall of a 2021 Supreme Court judgment that had declined leave to appeal. E had sought to challenge the refusal to waive a filing fee in relation to his judicial review application.

 

Mitchell v R  [2022] NZSC 89

21 July 2022

Unsuccessful application by M for leave to appeal against dismissal of his appeal against conviction and sentence on two charges of breaching a protection order and three charges of attempting to breach a protection order.

 

Philip v R  [2022] NZSC 88

20 July 2022

Successful application by P for leave to appeal on a question of whether the Court of Appeal (CA) was correct to allow a sentence appeal by the Solicitor-General. The High Court had sentenced P to one year’s home detention on five charges of possession of methamphetamine for supply. The CA had substituted a sentence of two years, 11 months' imprisonment.

 

Anderson v NZI International Acceptances Ltd  [2022] NZSC 85

11 July 2022

Unsuccessful application by A for leave to appeal against a 2022 judgment that had refused to recall a 2006 judgment. The 2006 judgment had been in relation to a mortgagee sale of A's family farm in 1988.

 

Tomar v Tomar  [2022] NZSC 84

04 July 2022

Unsuccessful application by VT for leave to appeal against refusal by the Court of Appeal (CA) to grant him leave to appeal. VT had unsuccessfully applied to bring a second appeal to the CA against relationship property orders made in the Family Court and upheld by the High Court.

 

Lyttle v R  [2022] NZSC 83

04 July 2022

Unsuccessful application by L for leave to appeal against an award of $75,000 made against the Police for procedural failings in his prosecution for murder. L had sought $150,000 to be paid equally by Police and the Crown prosecutor. The lower Courts had found that responsibility for disclosure failures rested with Police, not with the Crown prosecutor.

 

C v R  [2022] NZSC 82

01 July 2022

Unsuccessful application by C for an extension of time to apply for leave to appeal against his conviction in 2016 for (a) sexual offending against his step-daughter and (b) supplying her with cannabis.

 

Barton v Chief Executive, Department of Corrections  [2022] NZSC 81

01 July 2022

Unsuccessful application by B for leave to appeal against the Court of Appeal’s refusal of his application for habeas corpus in relation to not being granted parole.
